Article 1. Name and Domicile
Section 1. The Councul shall be called the BELARUS CRICKET COUNCIL hereinafter referred to as “[BCC]
Section 2. The principle place of business of the BCC shall be at Str. International 33/2, Gomel, Belarus
Article 2. Objectives, Authorities and Responsibilities
Section 1. The OBJECTIVES of the BCC are:
1.01 To promote and develop the sport of Cricket in Belarus and to encourage participation in the sport by natives.
1.02 To gain and maintain membership with the International Cricket Council (ICC) and any regional European body.
1.03 To select the best and most suitable players available and eligible to represent BCC at international Cricket events.
1.04 To encourage relations between the many different nationalities that play cricket through a common interest.
Section 2. The AUTHORITIES of the BCC are as follows:
2.01 BCC may promote the sport of Cricket by targeting those teams/individuals who it sees a being potentially active future participants.
2.02 BCC will oversee coaching programmes at all levels of Cricket in Belarus from grass roots level to national representative players.
2.03 BCC will appoint any representative(s) to the international Cricket boards such as ICC and regional associations.
2.04 BCC has the sole authority to select Belarus National Team to compete at international Cricket events sanctioned by international councils under official supervision of Belarussian Sport ministry or any authorized government institution.
2.05 BCC has the authority to make any by-laws as it deems necessary in order to achieve its objectives.
2.06 BCC has the authority to raise funds as it deems necessary in order to achieve its objectives.
2.07 BCC has the authority to decide questions on the status and discipline of players and officials and disputes between members.
Section 3. The RESPONSIBILITIES of BCC are as follows:
3.01 Stage public relations events to introduce Cricket to potential new cricketers as identified.
3.02 Stage coaching clinics for cricketers of all abilities and introduce suitable coaching programmes.
3.03 Publicize the sport and highlight the achievements of Belarus Cricket.
3.04 Apply to ICC for membership.
3.05 Maintain membership with ICC once obtained by adhering to and abiding by the statutes and corresponding by-laws of ICC.
3.06 Conduct periodic Cricket matches for the purpose of selecting the best players in the country for national and international events.
3.07 Observe and interview prospective players for international Cricket events to ascertain their discipline and attitude as appropriate representatives of the Belarus National Team.
3.08 Ensure that qualifications of players to represent the Belarus National Team in specific international events are strictly observed.
3.09 Maintain an accurate record of its members.
3.10 Keep an accurate record of all matches.
3.11 Maintain accurate records of all finance, properties and grants to the BCC.
Article 3. Membership
Section 1. BCC shall be comprised of all individuals and Teams that are admitted to membership.
Section 2. Individual members of the BCC are those members of any Cricket club who are in turn members of the council, regardless of race, sex, age, religion, or creed .
Section 3. Members shall be in good financial standing as required by BCC.
Section 4. Every member shall declare his(or her) opposition to any discrimination on the grounds of race, sex, age, religion or creed .
Section 5. The Executive Committee of the BCC may at any time, by resolution of which proper notice has been given in accordance with the by-laws and by a majority of all its members, expel a member for conduct inconsistent with the responsibilities as a member of the council, subject to such expulsion being ratified by a majority of the members voting at the next meeting of the GENERAL COMMITTEE [GC].
Article 4. Organization and government
Section 1. The individuals and Team that have been duly qualified and admitted to membership shall constitute the BCC.
Section 2. The GENERAL COMMITTEE [GC] shall be the legislative body of the BCC. The ultimate authority governing the conduct of the BCC shall be vested in it.
i. All members shall be represented on the GC within the provision of such by-laws as are determined by the Executive Committee of the BCC.
ii. Ordinary Meetings of the GC shall be held at regular intervals as decided by the members.
iii. Extraordinary meetings of the GC shall be held upon the request of the Executive Committee of the BCC. The Committee will convene monthly Meetings at a time and place determined by the said Committee. If necessary, emergency meetings to discuss any new matter may be called by the President from time to time.
Section 3. The Executive Committee shall be the Executive body of the BCC. It shall be responsible for the activities of the BCC.
i. The Executive Committee shall consist of a President, vice-president, Secretary, Treasurer, Assistant Secretary/treasurer, Promotion and Marketing Officer, Public Relations Officer, Head Coach, Coach Assistants, Head of Discipline Committee.
ii. The Executive Committee shall legislate the BCC, each will be given in writing by the President in an effort to ensure that the Objectives, Authorities and Responsibilities of the Commission are met, which will be amended accordingly whenever it becomes necessary .
Section 4. Except the Heads of Coaching and Discipline Committee and their Assistant, The President and other members of the Executive Committee shall be elected at each ordinary meeting of the GC annually and they shall hold office until the next ordinary meeting of the GC. This Meeting will be held at the beginning of each year with a quorum of 80% members.
The President shall:
i. Represent the BCC.
ii. Preside at all meetings of the GC and the Executive Committee.
iii. Be “ex officio” member of all committees and commissions of the council.
iv. Deal with matters of urgency arising in the Executive Committee.
v. Be the custodian of all papers and records pertaining to the affairs of the council.
vi. Signature of all financial transaction of the BCC.
vii. Submit a Presidential report at the yearly ordinary meeting of the GC.
Section 5.
The Vice President shall:
i. Assist the President in any capacity that the GC shall deem necessary.
ii. Preside at meetings in the absence of the President.
iii. Perform the duties of the President should He /she become unable or
iv. Unwilling to perform such duties until such time as a new President can be elected.
v. Be ready to accept and direct new projects proposed by the Executive Committee and endorsed by the President.
Section 6. One Committee member shall be appointed from each of the
member Team of the BCC.
i. They will be the representatives of their teams, or be appointed by the Executive Committee if he/she is already elected as a member of the Executive Committee or is unable to stand for the position.
ii. They shall hold office until their next regional elections.
iii. They shall deputies for the President whenever requested by him/her and assist him/her in carrying out duties.
Section 7. The Secretary shall:
i. Keep minutes and records of all meetings of the GC and the Executive Committee.
ii. Be “ex officio” of all committees, commissions and boards of the BCC.
iii. Conduct the correspondence of the BCC and translate into action the decisions of the Executive Committee.
iv. Submit a Secretarial report of activities and events undertaken during the year at the yearly ordinary meeting.
Section 8. The treasurer shall:
i. Be in charge of collecting any fees that the BCC shall deem
necessary and appropriate.
ii. Keep clear records of all such fees collected, and also of any
expenditures made by the BCC at least four times per year and upon request.
iii. Submit all financial records to an independent auditor for review once annually.
iv. Notify members of late fees and notifying the BCC of non-paying
members.
Section 9. The Assistant Secretary / treasurer shall:
i. Keep minutes and records of all meetings of the GC and the Executive Committee in the absence of the secretary.
ii Assist the Secretary in record keeping and minute taking at the GC and the Executive Committee.
iii Assist the treasurer in maintaining financial records .
iv. Keep records of all financial transaction in the absence of the treasurer.
v. Assume the responsibilities of the Secretary should he/she neglects his/her duties until the next ordinary meeting of the GC.
vi. Assume the responsibilities of the treasurer should he/she become unable or neglect his/her duties until the next ordinary meeting of the GC.
Article 5. Amendments
This constitution may be amended, added to or rescinded by a resolution of the GC at any of its ordinary meetings or any extraordinary meeting specifically called for such purpose. A majority of the NGC must be represented for such amendments to be approved by the Executive Committee.
Article 6. Final Provisions
Section 1. The BCC recognizes the right of members to organize their own leagues and competitions and to adopt rules governing the same. The BCC shall recognize these leagues and competitions as soon as the rules have been filed and approved by the Executive Committee provided always that these leagues and competitions are played in accordance with the Laws of Cricket.
Section 2. Teams and their members agree to submit all disputes to an arbitrator by mutual consent. Teams and their members shall not bring to a court of justice any disputes with the BCC or other teams and their members.
Section 3. In case of dissolution of the BCC the remaining assets shall be donated to the member teams.
Section 4. All matters not provided for shall be settled by the Executive Committee whose decision shall be final.
Article 7. Effect
This constitution shall take effect upon its approval.
